Illegal to Swim in the Potomac -- or is it?

Everybody knows its illegal to swim in the Potomac -- or is it?

Over beers the other night, one person claimed that it is not swimming that is illegal, but rather it is illegal to enter the Potomac from public land. According to this theory, that's why you see boaters and water skiers in the water.

Does anyone have an actual cite to law or code that makes swimming illegal? A friend I know has a waterfront house and if its okay to enter from private land, y'all are invited for an OWS!

Had to laugh at swimming being described as "primary contact recreation" but I guess that's why water skiers are legal.

But my friend's waterfront house is in Virginia, beyond the rule making authority of DC.

So, anyone know about swimming in the Potomac in Virginia? Wave One does it every week during the summer, and then there's those Gunston events, so maybe its OK from private land (with permission, obviously)????
